This document is a working draft.
It has been written against how Basemarks actually intends to operate, but it has not yet been reviewed by counsel and it is not yet in effect. Basemarks is not taking bookings and is not collecting customer health information. This page is published so the structure is in place and can be reviewed; the final version will carry an effective date.
1. What these terms cover
These terms govern your use of this website and any body composition or bone density measurement service you purchase from Basemarks. By booking a scan, you agree to them.
2. What we provide — and what we don't
Basemarks provides body composition and bone density measurement for wellness and fitness purposes.
We do not provide medical diagnosis, treatment, or medical advice. A scan performed here is not a substitute for evaluation by your physician, and nothing in your report should be treated as a diagnosis or as a reason to start, stop or change any medical treatment. If something in your results concerns you, take it to a qualified healthcare provider.
In particular: a whole-body scan produces a single skeleton-wide bone density average. It is not the site-specific hip and lumbar spine study used clinically to assess bone health, and it must not be treated as one.
3. Eligibility and screening
You must be 18 or older to book a scan for yourself. Scans for minors require a parent or legal guardian present and consenting.
Completing the health screening questionnaire honestly and accurately is a condition of service. We rely on your answers to determine whether scanning is appropriate for you. We may decline to perform a scan, or postpone it, where the screening indicates that we should — including where there is any possibility of pregnancy or a recent contrast or nuclear medicine study.
Declining a scan on those grounds is not a judgement about you. It is the point of asking.
4. Appointments and payment
Scans are prepaid at the time of booking. Prices are shown before you pay and are the price you pay — we do not add fees at checkout.
Cancellation, rescheduling and no-show terms are set out in our cancellation policy, which forms part of these terms.
5. Your results
Your report is yours. You receive a copy and you may share it with anyone you choose. We retain a copy so that future scans can be compared against it.
Measurements are subject to the inherent precision limits of the equipment and method. Results from different scanners or different facilities are not directly interchangeable, and we make no representation that they will be.
6. Your conduct on site
Please follow reasonable instructions from our staff regarding positioning, metal removal and safety. We may end an appointment where a guest is abusive to staff or to other guests. Our facility is a shared space and we intend to keep it a comfortable one.
7. Website content
The educational material on this website is general information, not personal advice. We take considerable care with it and cite our sources, but it is not tailored to your circumstances and should not be relied on as if it were.
Content on this site is our property and may not be republished wholesale, though you are entirely welcome to link to it or quote it with attribution.
8. Limitation of liability
To the fullest extent permitted by Georgia law, our liability arising out of or relating to the services is limited to the amount you paid for the service in question. We are not liable for indirect or consequential losses, including decisions you make on the basis of your results.
Nothing in these terms limits any liability that cannot lawfully be limited.
9. Governing law
These terms are governed by the laws of the State of Georgia, and the courts of Gwinnett County, Georgia have jurisdiction over any dispute arising under them.
10. Changes
We may update these terms. The version in effect at the time you book is the version that governs that booking.
